Raise has nothing to do with GC processing.Decision of Raise Limit is set by employer and promotion does comes with change in job description.Keep one thing in mind Corporations make profit out of everybody whether its customers or employees doesnt matter.Corporations exists to make profits.by the way do you work for non-profit organization ?? in that case things are a little different based on finanicial availability.

I am on H4 for the past few years. This year I am planning to switch to H1. A consulting firm of only 5 employees is willing to sponsor my H1. I would like to know the chances of my H1 getting approved. Because the company is small am I going to face any problems? What will be the impact of the size of the company on H1 approvals.
I would really appreciate your inputs because this time I want to resume my career again and I don't want to have any problems with H1.

My H1-B was approved in octubre 2008, I would like to go to my home country but i don't have a visa to be able to come back.

We, July 2 filers, just got our receipts. So you are not that bad. After 90 days wait, you are entitled to ask for an investigation, but, as it appears, USCIS is not yet fully finished with all the receipts for July-Aug filers. They said that they will be done with it by month end. You may want to wait until then.

My wife has H4 stamped and valid till Nov 2008 but from Oct 2007 she changed her status to H1B. She has I797. My question is when she goes to India does she need to stamp H1 B or she can reenter on already stamped H4 ?

One of my friend is in the same situation and he has been told by his lawyer that he can get his part-time concurrent H1 Extn for 3 years based on fulltime concurrent H1 approved I-140.
He is going to apply the same soon.

thats what I did when I moved back to company A. My lawyer suggested as long as company A did not cancel your H1 approval you are good to go!!..Hope this helps. Good luck.

I can tell you only my plans -- I am planning to visit India for 1 week. My H1-B is valid till 2010 so I will use H1-B visa to renter at Chicago. Also, 1099 or W2, it does not matter. You can take either one.

"I would like to hear your professional opinion on the following issue: I have been on F-1 visa for 7 consecutive years. I have an employer that has sponsored me as a Graphic Designer. In fact I have obtained the I-140 through him already. I recently applied for employment AOS (July 25th) with my wife (She is on F2 visa) and I'm currently waiting on the Notice Receipt. School starts on August 20th and I'm hesitant on when exactly the new Immigrant Status starts. Do I still need to enroll for classes in order to maintain my visa? I don't intend to finish school due to financial difficulties, when exactly may I drop out from school? Should I remain enrolled up until I receive the EAD and AP? I'm not familiar with the operation of your particular camera, but I can tell you what's happening. If you're getting ablur when shooting moving subjects indoors, you are most likely not getting a fast enough shutter speed. Do you have your flash turned on?

Could you please pm us the IP address of your machine. It will help us to diagnose the problem and/or let you know the reason. Its possible that your work environment is using NATing. So all machines from within that network will propagate the same external IP address. If you could send us your IP address at work, we will be able to diagnose the problem.

My Attorney filed my EAD application with invalid A# number in May,08 and my EAD got approved in July,08 with Invalid A# number. While going through my EAD card, I found invalid A# number on my EAD Card.
I sent a email to attorney regarding this one and he says that they filed EAD with invalid A# number and USCIS approved the EAD with Invalid A# number.It should not be an issue and the only way to �fix� this would be to file a new I-765 application and get a new EAD. It is certainly not an issue for employment eligibility at your current company".
Attorney also saying that they can file new EAD, but he needs send my Original EAD card along with the application.
My Questions are
1).Do I need send my Original EAD along with new EAD application ? Can I file with new EAD application with photo copy of my current EAD ?
2). Can I keep my current EAD (with Invalid A# Number on it) and apply next re-newel period with correct A# Number?

EB-3 ROW current PD is March 2003, his PD is 2006, so he is not current.
Since you do not belong india nor china, I assume your case is current. So, they probably approving your case. Good luck

i have strage problem..i am not weather its a problem or not..i have filed my GC in 2004 December and you all know that after that the BEC process came in every thing went to BEC's..and i had no hope on that file and i asked my employer to process my GC under PERM process in 2006 april and i got the Labor and I-140 approved in 6 months...and mean while i got the 2004 labor approved in Feb 2007 and asked my employer which one will be the best and he recommended me apply for I-140 for 2004 labor and wait untill the dates become current and he was expecting the 2004 will become current...so we have applied for I-140 for 2004 labor on May 1st 2007 and the status is pending...now my questios is..
1) Is there is any problem if i use the 2004 labor and apply for I-485.
2) When attorney file for I-140 did they mention any where in that forms that i do not have any immigration petiton has been submited before?
3) If they mention no (miss communication) and applied for I-140 for 2004 labor but in fact there is a petition (I-140) submited for me for my 2006 labor.will this be a problem for my 485 approval?

How long does it take these days to process greencard in L1 Category these days. If the sponsor company applies L1 visa for a very experience worker, what is the best type of L1 visa needs to be applied that will lead to a quicker greencard status.

started following IV after my friend told me about it. got some useful info and really admire the time members put to answer queries. this is my post and I hope I get some info here. my hubby is looking to relocate to south FL so we both can live and work in same place. he did get couple offers - one from a insurance firm and another from a software company - Citrix. looks like first one will only do EB-3 although the position requires 5+ years exp. does anyone know if Citrix does GC under EB-2 ?
