Thanks for participation in this forum. I think if US consulate denies visa in Canada then if one has AP (EAD and pending Adjustment of status) then she/he can come back to US without home country. Is that right?
I just wanted to validate my understanding.

You need to be in valid H1B status to get H1B extension. If you have abandoned it or it has expired, then you are subject to H1B quota. But I don't have any document/memo to support it. Wait for more senior people's response.

Hi all,
Need your advise. I have an approved PERM Labor (2006)
Also filed for I-485 in July 2007, got EAD, AP.
Lately i noticed that my Date Of Birth is incorrect in page 5 of ETA 9089 Labor Form. This error is in section J Alien Information.
How should i correct it? Please advise.

LOL..its good to have a sense of humor.
I wish there was a way to know if a case is pre-adjudicated.
This would help us to not file for H1 extensions, EAD, and AP. Which inturn would free up time for the officers to work on improving processing dates.
Offcourse, i am still happy about the date movement.
It just makes you wonder , if they USCIS was deligent in not wasting visas in previous years, even EB-3 would have had a reasonable date.

No need for exp certificate in applying for H1.
At embassy/consulate, for visa stamping, you should keep it as they may like to verify. It is not mandatory but good to have.

a) Am I eligible to apply for H1 extension (I don't want to use EAD)?
Yes, you can apply for H1 extension when I-485 is pending
b) If Yes, will I get 1 Year or 3 Years?
Once I-140 is approved, you will get an extension for 3 years.

Not sure about what can you do by yourself � in this situation would contact some immigration attorney.
More than likely you need to file Motion to reopen (and gain some time)� otherwise you would end up in a one way street �-however not sure about who will need to file (you or your father)? Also not sure about what would be the basis for filing such a case .
Deportation � Since (I assume) you are in the US legally since 98 even if they start the deportation process probably you can file for some relief (I guess if you are here for 7 or 10 years -legally! -then in a case like that there could be some way to avoid deportation, but this would not be automatic).
I would consult with a immigration lawyer....

"I would like to hear your professional opinion on the following issue: I have been on F-1 visa for 7 consecutive years. I have an employer that has sponsored me as a Graphic Designer. In fact I have obtained the I-140 through him already. I recently applied for employment AOS (July 25th) with my wife (She is on F2 visa) and I'm currently waiting on the Notice Receipt. School starts on August 20th and I'm hesitant on when exactly the new Immigrant Status starts. Do I still need to enroll for classes in order to maintain my visa? I don't intend to finish school due to financial difficulties, when exactly may I drop out from school? Should I remain enrolled up until I receive the EAD and AP? Oi! That IS the colour version! :D It might be a tad underexposed I guess, but any more and I would've ended up with bright white water. I could go back at a different time of day when the sun is at a more opportune spot though. I'm just not sure if it's worth it. (I guess one way of finding out is to actually go down there when the sun pops out :))
I think I'm better off hunting for more traditional landscapes (and eventually some animals -- I hope to catch some musk oxen in July, dunno what I'll do before that). :)
