I took an infopass appointment last october and my FBI name check status was pending. After seeing the USCIS memo on march4th that all namecheck pending for 180 days has been cleared by feb 28th 2009, i went again for an infopass appt last week. IO toldme that my namecheck is still pending.
So i contacted my senators office same day and sent all my info along with the USCIS memo. Next day senators office called me back and told me that they called USCIS and came to know that my name check has been cleared. Senators office told me that infopass information could be wrong or may not have been updated.
IS that a possibility ? any inputs ?

what makes you think that i am an anti-immigrant, and do you think that i am giving publicity. this is from an ad that i came across that says that 1.5 million immigrants are being brought into the country to work annually. i wanted to bring this to the attention of the forum so that we can do something to stop this false information propagation. otherwise, think about the hatred the american public will have when the time comes for CIR to be implemented. for every call we make, there will be 10 calls to oppose. unless we stand up and fight the misinformation, we are not going to see any progress. and maybe it is easy for you to label anyone as an anti-immigrant being an EB2. I lost out on my 2001 PD due to the mistake of my lawyer and am now saddled with a 2004 PD. My H1B visa end date is 30July2013(PED or expiration date in H1B visa stamp) and my I-94 end date is 10-Aug2013.But in I797B the end date is 30July2011. Can you please help me that i need to do my H1B visa extension within 30July2011?....please clarrify that visa validity depends on I94 or Visa end date or I797B end date....thanks

I'm a green card holder (singapore citizen) who got married while being a US PR. I wish to apply for my wife (singapore citizen) a green card.
How long is the typical wait?
See visa bulletin. Your case is Family Based (FB) 2A. Currently, it is at 01APR06 (i.e., the applications that USCIS received before 04/01/2006 are eligible to be approved). You need to study how quickly the dates move by going through VISA bulletins in the last 3-4 years, but my guess would be about 5 years.

while applying, is it true that my wife can't enter the US?
AFAIK, not on the basis of her GC application, but if she gets another (dual-intent) VISA, say H1B, then she can enter US.

After 5 years of being PR, you can become US Citizen. After you have become a US citizen, your wife's GC application will no longer be subject to a quota and she should get GC within a few months (processing time).

Hi - I am on 7th Year of my H1. My I-140 has been approved. My I-485 is pending for while plus my PD is not current as of Jan 09. In this case...
a) Am I eligible to apply for H1 extension (I don't want to use EAD)?

My birth was regiestered under totally different first name, also DOB is off by 9 days (10th June instead of 1st June). Since the birth is registered they are not issueing non-availability cert. . What to do?
I have both parents affidavits, school leaving cert, 10th class cert, PAN card showing date/place same as that in passport. Filing a civil case in India is the option but it could take more than a year. since my PD is Sep04, my 485 could be processed within months.

I was in some what similar situation but my H1 transfer was not approved to the new company and my attorney suggested moving back to the previous employer.
I guess it is possible but if your H1 transfer was approved then you might have to apply for another transfer.
I worked with company A for 6 months and then transferred H1B to new company B with whom I worked for 1.5 years. Meanwhile company A did not cancel my H1B and now when I am thinking of joining company A. Can we use older H1B petition. Is it ok to use older H1B petition or should we cancel older H1B on file and file new H1B transfer?

some where i read in the forum if we leave the country without the approval of ap our 485 status will be abonded.
If you leave the country after getting your I-485 receipts then its okay whether you get your Advance Parole papers or not since you are going for H1 stamping and are not going to use AP anyway.
It does not matter. Some people do not even file for AP if they are going to use their H1 visa to re-enter the country.
But remember your I-485 receipt is very important. Always keep it handy ( do not leave without it ):)

I'm facing a frustrating issue and am hoping that someone can provide help on this. I'm on my H1 10th year extn. My I-140 (EB-3) was recently approved and I cannot apply for I-485 as the visa dates are not available. My Company recently changed their name from ABC, doing business as XYZ, to DEF, doing business as XYZ (the doing business as part of the name is the same and there was no merger, just a name change).
My first question is does this invalidate my approved I-140 and should I refile the I-140. Also, when I file my H-1 extension what document should I provide to prove the name change (or is it even needed?)? Any help on these 2 questions would be greatly appreciated. Thanks.

Just some hope. But if the trend maintains then they will have lesser pinch on the H1 processs. Hopefully that will help improve GC process as well.
